Motion by the appellant to stay the transfer of the referee's deed to the subject property pending hearing and determination of an appeal from an order of the Supreme Court, Kings County, dated June 2, 2006, and cross motion by the respondent to dismiss the appeal on the ground that the appellant raises issues not properly before this court.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are denied.
