| DECISION & ORDER ON MOTION |
Motion by the respondent Presentment Agency on an appeal from an order of disposition of the Family Court, Kings County, dated July 6, 2005, to strike stated portions of the appellant's brief on the ground that the appellant has, in effect, conceded that there is no merit to his claim that his right to a speedy trial was violated.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is held in abeyance, and is referred to the Justices hearing the appeal for determination upon the argument or submission of the appeal.
