| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to recall and vacate a decision and order on motion of this court dated May 15, 2006, which dismissed an appeal from a judgment of the Supreme Court, Nassau County, entered October 21, 2004, on the ground that the judgment was entered upon stipulation, to reinstate the appeal, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
