ORDERED that the appeal is dismissed, without costs or disbursements, as the appeal has been rendered academic by a decision and order of this court which determined appeals from two orders of the Family Court, Queens County, dated January 6, 2005 (Appellate Division Docket No. 2005-08768), and July 8, 2005 (Appellate Division Docket No. 2005-09062), respectively (see Matter of Rospigliosi v Abbate, ______ AD3d ______ [ 2d Dept., July 18, 2006]).
