Motion by the respondent to dismiss as abandoned an appeal from a judgment of the Supreme Court, Kings County, rendered September 16, 1999.
Upon the papers filed in support of the motion and the papers filed in opposition or in relation thereto, it is
ORDERED that the motion is denied, with leave to renew unless, on or before October 23, 2006, the appellant either retains counsel to perfect the appeal and provides the name and address of retained counsel to the Clerk of this court, moves for poor person relief and the assignment of counsel, or moves to proceed pro se.
