| DECISION & ORDER ON MOTION Motion to Dismiss Appeal |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Queens County, dated February 3, 2005, on the ground, inter alia, that the appeal is without merit, and separate motion by the respondent for the assignment of counsel to defend the appeal and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motions and the papers filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge time is granted, the respondent's time to serve and file a brief is enlarged until September 28, 2006, and the respondent's brief shall be served and filed on or before that date; and it is further,
ORDERED that the branch of the motion which is for the assignment of counsel and the motion to dismiss the appeal are denied.
