DECISION & ORDER ON MOTION

Motion by the appellant Tannor Contracting Company, Inc., on appeals from an order of the Supreme Court, Richmond County, dated March 15, 2006, for leave to perfect its appeal separately from the appellant Welsbach Electric Corp., and to stay the trial in the above-entitled action pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to perfect the movant's appeal separately from the appellant Welsbach Electric Corp. is granted and the movant may perfect its appeal by filing a record or appendix and its brief; and it is further,

ORDERED that the motion is otherwise denied.
