| DECISION & ORDER ON MOTION |
Motion by Susan Betz Jitomir, Esq., new counsel for the appellant, inter alia, for leave to serve and file a replacement brief and appendix, if she deems it necessary, on an appeal from a judgment of the County Court, Westchester County, rendered November 16, 2004.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and on or before October 30, 2006, Susan Betz Jitomir, Esq., shall advise the Clerk of this Court, in writing, whether she wishes to (1) adopt the appendix and brief filed by the appellant's former counsel, (2) serve and file a new appendix and brief, or (3) file a supplemental brief and/or a supplemental appendix.
