DECISION & ORDER ON MOTION

Motion by the respondent to strike the appellant's brief on an appeal from a judgment of the Supreme Court, Queens County, rendered June 27, 2004, on the ground that the appellant has not secured the complete transcript of the proceedings.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is denied as the complete transcript of the proceedings has been filed with the clerk of this court; and it is further,

ORDERED that on the court's own motion, the respondent's time to serve and file a brief is enlarged until October 6, 2006, and the respondent's brief must be served and filed on or before that date.
