DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to reargue his prior motion, in effect, to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Nassau County, rendered July 23, 2002, and to substitute retained counsel, which was determined by decision and order on motion of this court dated June 12, 2006.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied, with leave to renew on or before October 6, 2006, upon proof in the form of either a retainer agreement or a letter from an attorney that the appellant has retained an attorney to prosecute the appeal.
