DECISION & ORDER ON MOTION

Motion by the petitioner, inter alia, for leave to appeal to this court from an order of the Supreme Court, Queens County, dated August 4, 2006, and to enjoin the respondents City of New York and Emily Lloyd from awarding a certain contract to the respondent Clean Venture, Inc., pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to this court is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
