DECISION & ORDER ON MOTION

Motion by the petitioner in a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Westchester County, dated August 9, 2006, inter alia, to enjoin the respondent New York State Liquor Authority from enforcing a determination of that agency dated May 22, 2006, revoking the petitioner's liquor license, pending hearing and determination of the proceeding.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
