DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Queens County, dated January 24, 2005, to permit her attorney to refer at the oral argument on the appeal to an order dated February 17, 2006, issued by the respondent New York State Division of Housing and Community Renewal, granting a major capital improvement rent increase.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
