DECISION & ORDER ON MOTION

Motion by the appellant pro se for a further enlargement of time to serve and file a supplemental brief on an appeal from a judgment of the County Court, Orange County, rendered December 17, 2002.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the court's own motion the decision and order on motion of this court, dated April 6, 2005, which granted the appellant's motion for leave to serve and file a supplemental brief is recalled and vacated; and it is further,

ORDERED that the appellant's motion for leave to file a supplemental brief is denied.

The appellant pro se has failed to file a supplemental brief although afforded a sufficient opportunity to do so.
