SCHEDULING ORDER

Appeal by Ben Scott from an order of the Family Court, Kings County, dated May 31, 2006. Pursuant to Family Court Act §§ 1118 and 1120, and upon the certification of Jane Fosbinder, dated August 30, 2006, it is

(2) the respondent is not interested in responding to the appeal, or that he or she has been unable to contact the respondent, and wishes to be relieved of the assignment.
