DECISION & ORDER ON MOTION

Second motion by the petitioner, inter alia, for leave to reargue a motion for permission to prosecute the above-entitled proceeding as a poor person, which was determined by decision and order on motion of this court dated February 8, 2006.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is to waive the filing fee is denied as unnecessary, as the appellant has already paid the filing fee; and it is further,

ORDERED that the motion is otherwise denied.
