Motion by the appellant, inter alia, to stay the trial in the above-entitled action pending hearing and determination of an appeal from an order of the Supreme Court, Westchester County, entered June 26, 2006.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion which is for a stay is granted and the trial is stayed pending hearing and determination of the appeal; and it is further,
ORDERED and the motion is otherwise denied.
