| DECISION & ORDER ON MOTION |
Motion by the defendant pursuant to CPL 460.30(1) to enlarge the time to seek leave to appeal to this court from an order of the Supreme Court, Queens County, dated May 4, 2006, which denied his motion pursuant to CPL 440 to vacate a judgment of the Supreme Court, Queens County, rendered November 28, 2000.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is granted; the defendant's time to move for leave to appeal is enlarged until November 6, 2006.
