| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate a decision and order on motion of this court dated April 18, 2006, which granted the appellant's motion to withdraw an appeal from an order of the Supreme Court, Kings County, dated June 14, 2005, and to reinstate the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the decision and order on motion dated April 18, 2006, is recalled and vacated and the appeal from the order dated June 14, 2005, is reinstated; and it is further,
ORDERED that the appellant shall re-serve and refile its brief on or before October 6, 2006; and it is further,
ORDERED that the respondents' time to serve and file brief is enlarged until November 6, 2006, and the respondents' briefs must be served and filed on or before that date.
