| DECISION & ORDER ON MOTION |
Motion by the appellant-respondent on an appeal and cross appeal from an order of the Supreme Court, Nassau County, dated December 15, 2005, to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is granted to the extent that the appellant-respondent's time to perfect the appeal is enlarged until November 20, 2006, and the joint record or joint appendix on the appeal and the appellant-respondent's brief must be served and filed on or before that date, and the motion is otherwise denied; and it is further,
ORDERED that the respondent-appellant shall serve and file his answering brief, including his points of argument on the cross appeal, in accordance with the rules of this court (see 22 NYCRR 670.8[c][3]).
