| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to consolidate an appeal from an order of the Supreme Court, Kings County, dated March 9, 2005, with an appeal from an order of the same court dated April 19, 2006, and cross motion, inter alia, by the respondents to dismiss the appeal from the order dated March 9, 2005, for failure to timely perfect the same in accordance with the rules of this court (see 22 NYCRR 670.8).
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the branch of the cross motion which is to dismiss the appeal from the order dated March 9, 2005 (Appellate Division Docket No. 2005-04891), for failure to timely perfect the same in accordance with the rules of this court (see 22 NYCRR 670.8) is granted, and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the cross motion is otherwise denied; and it is further,
ORDERED that the motion is denied as academic.
