Motion by the appellant to stay enforcement of an order of the Supreme Court, Westchester County, dated September 6, 2006, pending hearing and determination of an appeal therefrom, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for a stay is denied as academic as the appellant was released from the hospital on September 15, 2006; and it is further,
ORDERED that the motion is otherwise denied.
