Motion by the respondent on an appeal from an order of the Supreme Court, Kings County, dated October 3, 2005, to strike pages 73-74 of the appendix on the ground that the material is dehors the record.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted, pages 73-74 of the appendix are stricken, and the Clerk of this court, or his designee, is directed to remove pages 73-74 of the copies of the appendix on file with this court.
