| DECISION & ORDER ON MOTION |
Motion by the plaintiff, the appellant-respondent in Appeal No. 1 and the appellant in Appeal No. 2, to enlarge the time to perfect an appeal and cross appeal from an order of the Supreme Court, Westchester County, dated November 29, 2005 (Appellate Division Docket No. 2006-00138), and an appeal from an order of the same court dated November 30, 2005 (Appellate Division Docket No. 2006-00142).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the plaintiff's time to perfect the appeals is enlarged until October 23, 2006, and the joint record or appendix on the appeals (see 22 NYCRR 670.8[c][1]) and the plaintiff's brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargements of time shall be granted; and it is further,
ORDERED that the respondent-appellant in Appeal No. 1 shall serve and file his answering brief, including his points of argument on the cross appeal, and the respondent in Appeal No. 2 shall serve and file his brief, in accordance with the rules of this court (see 22 NYCRR 670.8[c][3]).
