DECISION & ORDER ON MOTION

Motion by the petitioner-respondent to substitute AC I Shore Road, LLC as the petitioner-respondent in place of Waldbaum, Inc., on an appeal from a judgment of the Supreme Court, Nassau County, dated March 14, 2006.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted AC I Shore Road, LLC is substituted as the petitioner-respondent in place of Waldbaum, Inc., and the caption of the appeal has been amended accordingly.
