DECISION & ORDER ON MOTION

Motion by the assigned counsel for the appellant, inter alia, to be relieved of the assignment to prosecute an appeal from an order of the Family Court, Nassau County, dated July 14, 2006.

Upon the papers filed in support of the motion an no papers having been filed in opposition thereto, it is

ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursements, as no appeal lies as of right from the order (see Family Ct Act § 1112[a]), and we decline to grant leave to appeal; and it is further,

ORDERED that the motion is denied as academic.
