Motion by the appellant on an appeal from a judgment of the Supreme Court, Queens County, rendered November 19, 1996, for leave to reargue a motion to recall and vacate a decision and order on motion of this court dated January 14, 1997, granting the respondent's motion to dismiss the appeal, which was determined by decision and order on motion of this court dated October 29, 2004.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
