It is Ordered that the motion for a stay is granted on the condition that the appellant(s): (1) on or before October 10, 2006, pays the April 2006 [when the appellant(s) defaulted] to and including, the October use and occupancy to the petitioner, without prejudice, at $805 per month; (2) continues to pay monthly use and occupancy as it comes due, without prejudice; and (3) perfects the appeal for the January 2007 term of this court- the filing deadline is November 8, 2006. In the event of appellant's failure to comply with the foregoing conditions, petitioner may move on five days' notice for an order vacating the stay. The appeal may proceed on the original record and typewritten briefs.
