DECISION & ORDER ON MOTION

Motion by counsel assigned to represent the appellant in Family Court to be relieved, to assign new counsel to prosecute an appeal from an order of the Family Court, Richmond County, dated June 6, 2006, and for leave for the appellant to prosecute the appeal as a poor person.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from the order appealed from (see Family Ct Act § 1112[a]), and we decline to grant leave to appeal; and it is further,

ORDERED that the motion is denied as academic.
