Application by the defendant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from a decision of the County Court, Suffolk County, dated December 8, 2005, and a cross appeal from a determination of the County Court, Suffolk County, dated December 15, 2005.
ORDERED that the application is granted and the defendant's brief which was submitted to the Clerk of this court is accepted for filing; and it is further,
ORDERED that the plaintiff's time to serve and file a reply brief is enlarged until October 13, 2006, and the plaintiff's reply brief must be served and filed on or before that date.
