DECISION & ORDER ON MOTION

Motion by the appellant Dan Berman, joined by the appellant City of New York, to stay the trial of the above-entitled action pending hearing and determination of appeals from two orders of the Supreme Court, Queens County, dated January 27, 2006, and June 15, 2006, respectively.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and the trial in the above-entitled action is stayed pending hearing and determination of the appeals.
