Motion by the defendant for leave to appeal to this court from an order of the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts, dated August 31, 2006, which denied a stay of proceedings pending determination of the defendant's appeal to the Appellate Term, from an order of the Justice Court, Town of Monroe, Orange County, entered June 6, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is
ORDERED that the motion is denied; no appeal lies from the order (see CPLR 5703[a]).
