It is Ordered that the motion to vacate the dismissal of the appeal is denied. This Court notes that approximately 20 months elapsed from the filing the notice of appeal to the dismissal of the appeal on February 3, 2005 and approximately 19 months from the dismissal of the appeal to the date of the statement in support of the motion (September 11, 2006) to vacate the dismissal of the appeal.
