It is Ordered that the motion is granted, without opposition, to the extent of vacating the stay. The appellant has failed to comply with the order of this Court requiring the payment of accruing use and occupancy to the petitioner pending the determination of the appeal. The use and occupancy payments due for the months of July, August, September and October 2006 have not been tendered. The petitioner-respondent's answering briefs are to be personally served and filed by October 23, 2006. Reply briefs, if any, are to be served and filed by October 30, 2006.
