DECISION & ORDER ON MOTION

Motion by the appellant, on an appeal from a judgment of the Supreme Court, Nassau County, entered March 15, 2005, in effect, to amend a decision and order on motion of this court, dated April 7, 2006, which, inter alia, granted the appellant's motion to vacate so much of a decision and order on motion of this court dated February 10, 2006, as dismissed the appeal from the judgment for failure to timely perfect the same, and enlarged the time to perfect the appeal until June 13, 2006.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and the decision and order on motion of this court dated April 7, 2006, in the above-entitled case is amended by deleting from the third decretal paragraph thereof the words "June 13, 2006," and substituting therefor the words "October 31, 2006."
