Appeal by the People from an order of the Supreme Court, Queens County, dated October 16, 2002.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, as the order dated October 16, 2002, was superseded by an order of the same court dated December 6, 2002, and an amended order of the same court also dated December 6, 2002, and the appeals from the orders dated December 6, 2002, were determined by decision and order of this court dated November 15, 2004 (see People v Hodges, 12 AD3d 527).
