DECISION & ORDER ON MOTION

Appeal by Edward Patrick Cheatham, a/k/a Patrick Cheatham from a judgment of the County Court, Nassau County, rendered July 18, 1994. The appeal has not been perfected. By order to show cause dated June 22, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).

Upon the court's own motion and no papers having been filed in response to the order to show cause, it is

ORDERED that the appeal is dismissed.
