DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order and judgment (one paper) of the Supreme Court, Queens County, dated December 8, 2005, in effect, to direct the appellant to file a supplemental record containing the report of the court evaluator, and to enlarge the time to serve and file a brief, and cross motion by the appellant for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in relation thereto, it is

ORDERED that the motion and the cross motion are granted; and it is further,

ORDERED that the appellant shall serve and file a supplemental record containing the report of the court evaluator on or before November 24, 2006; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until November 14, 2006, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the appeal shall be calendared expeditiously when fully perfected.
