| DECISION & ORDER ON MOTION |
Motion by counsel assigned to represent the defendant in the Supreme Court, Queens County, to be relieved of the assignment to respond to an appeal from an order of the same court, dated December 15, 2005.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that counsel is directed to turn over all papers in the action to new counsel herein assigned; and it is further,
