| DECISION & ORDER ON MOTION |
Appeal by the defendant from a judgment of the Supreme Court, Queens County, rendered April 10, 1997. By decision and order on motion dated July 28, 1997, the defendant's motion for leave to prosecute the appeal as a poor person and for the assignment of counsel was denied with leave to renew upon proper papers. The defendant has not renewed the motion and the appeal has not been perfected. By order to show cause dated July 18, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned.
Upon the court's own motion, and no papers having been filed in response thereto, it is
ORDERED that the order to show cause is granted, and the appeal is dismissed (see 22 NYCRR 670.8[f]).
