| DECISION & ORDER ON MOTION |
Motion by the respondent to strike portions of the appellant's brief on an appeal from a judgment of the Supreme Court, Queens County, rendered September 21, 2001, as improper. Cross motion by the appellant to strike portions of the respondent's brief and to hold the appeal in abeyance pending determination of a motion before the Supreme Court, Queens County, of the appellant's motion pursuant to CPL 440.10.
Upon the papers filed in support of the motion and cross motion and the papers filed in relation thereto, it is
ORDERED that the motion and that branch of the cross motion which is to strike portions of the respondent's brief are held in abeyance, and are referred to the Justices hearing the appeal for determination upon the argument or submission of the appeal; and it is further,
ORDERED that the branch of the cross motion which is to hold the appeal in abeyance is denied.
