| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Family Court, Kings County, dated July 6, 2006, pending hearing and determination of an appeal therefrom and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition and relation thereto, it is
ORDERED that on the court's own motion, the appellant's notice of appeal is treated as an application for leave to appeal from the order dated July 6, 2006, and leave to appeal is granted (see Family Ct Act § 1112); and it is further,
ORDERED that the motion is denied.
