| DECISION & ORDER ON MOTION |
Motion by the plaintiffs for leave to appeal to this court from a decision of the Supreme Court, Kings County, dated September 7, 2006, respectively, and to stay the release of certain funds held in escrow pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this court is denied as no appeal lies from a decision (see Schicchi v Green Constr. Corp., 100 AD2d 509); and it is further,
ORDERED that the motion is otherwise denied as academic.
