DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent, Scott Eric Garil, for reinstatement as an attorney and counselor-at-law. By opinion and order of this court dated November 16, 1998, he was disbarred and his name struck from the roll of attorneys pursuant to Judiciary Law § 90(4) based upon his felony convictions in the County Court, Nassau County. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 26, 1994.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice law, including but not limited to his relationship to the principal of his former law firm whose surname was "Garil."
