It is Ordered that the motion is granted to the extent of continuing the stay of the execution of the warrant of eviction pending the determination of the appeal, presently noticed for the January 2007 term. Accruing use and occupancy is to be tendered to the petitioner-landlord on each subsequent rental due date, without prejudice.
