| DECISION & ORDER ON APPLICATION |
Application by the plaintiff-appellant and the intervenors plaintiffs-appellants pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect appeals from a decision of the Supreme Court, Richmond County, dated June 7, 2005, and findings of fact and conclusions of law and a judgment of the same court, both dated March 21, 2006.
ORDERED that on the court's own motion, the appeals from the decision dated June 7, 2005, and the findings of fact and conclusions of law dated March 21, 2006 are dismissed, without costs or disbursements, on the ground that no appeal lies therefrom (see Benedetto v O'Grady, 10 AD2d 628); and it is further,
ORDERED that the application is granted and the plaintiff-appellant's and the intervenors plaintiffs-appellants' time to perfect the appeal is enlarged until December 28, 2006, and the record or appendix on the appeal and the plaintiff-appellant's and the intervenors plaintiffs-appellants' brief must be served and filed on or before that date.
