DECISION & ORDER ON MOTION

Motion by the respondent's attorney, Thomas F. Liotti, for permission to release and turn over to the Grievance Committee for the Tenth Judicial District the files and records of the respondent, who is allegedly disabled and incapacitated, and for such other relief as the court may deem just and proper. The movant represented the respondent in connection with criminal charges which were brought against him in Nassau County and which resulted in his incarceration. By opinion and order of this court dated October 25, 2004, the respondent was disbarred upon his submission of a resignation. By decision and order on motion dated October 26, 2006, the instant application was held in abeyance and the matter was referred to the Office of Special Counsel to ascertain the state, location, and quantity of Mr. Rosen's files pre-inventory. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 15, 1966.

Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is

ORDERED that pursuant to 22 NYCRR 691.10(h), the motion is granted to the extent that Robert P. Guido of the Office of Special Counsel to the Presiding Justice for Grievance Matters, 30 Hoffman Avenue, Lindenhurst, N.Y. 11757-5011, is appointed to inventory the files of disbarred attorney Jay Wallace Rosen, which are currently in the possession of Thomas Liotti, Esq.
