It is Ordered that the motion is granted only to the extent of staying the execution of the warrant of eviction until after December 13, 2006. If, by said date, the appeal has been perfected for the February 2007 term and the appellant is current in the payment of use and occupancy, then the appellant may move for a continuation of the stay. Otherwise, the warrant of eviction may be enforced after December 13, 2006. The appellant is referred to 22 NYCRR § 640.6, regarding the amount of time by which an appeal must be perfected from an order/judgment of the Civil Court.
