In the event the appeal is not perfected by the February 2007 term - the filing deadline is December 12, 2007, the plaintiff-respondent may move on five days' notice for an order vacating this stay. This is without prejudice to the defendant posting an undertaking, pursuant to CPLR § 5519(a)(2), and thereby automatically staying any further efforts by the plaintiff to enforce the monetary judgment. Thereafter, the appellant may move in the trial court to vacate the restraining notice on the defendant's bank account, if so advised.
