DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, dated April 7, 2006, for leave to prosecute the appeal as a poor person, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied in light of the decision and order on motion of this court dated July 21, 2006, which denied the appellant's motion pursuant to CPL 460.30 to extend his time to take an appeal from the order.
